Terms of Service
These Terms of Service ("Terms") govern your access to and use of Pathways to Parenthood Inc.'s websites, applications, and services (the "Platform"). By using the Platform, you agree to these Terms.
1) Services & Eligibility
The Platform provides AI-enabled navigation tools, educational content, coordination (at your direction) with clinics and related providers, and features to organize your information. You must be at least 18 and legally able to enter these Terms.
2) No Medical Advice
PtP is not a healthcare provider and does not offer medical advice, diagnosis, or treatment. Content, recommendations, or AI-generated insights are for informational purposes only and are not a substitute for professional judgment. Always seek the advice of a qualified health professional for questions about your care.
3) Accounts & Security
- Provide accurate, current information and keep it updated.
- Safeguard your credentials and promptly notify us of unauthorized use.
- You are responsible for activity under your account.
4) Acceptable Use
- No unlawful, infringing, defamatory, or harmful content or conduct.
- No scraping, reverse engineering, interference, or security circumvention.
- No uploading of malware or attempts to access data you do not own or control.
- No misuse of the Platform to provide medical advice without licensure.
5) Intellectual Property
The Platform (including software, models, design, text, graphics, and trademarks) is owned by PtP or its licensors and protected by law. Except as expressly permitted, you may not copy, modify, distribute, or create derivative works. “Partners to Parenthood,” related logos, and service marks are proprietary to PtP. All rights reserved.
6) Fees & Billing
Certain features may require payment or subscription. You authorize our payment processor to charge your chosen method. Fees are non-refundable except as required by law or our posted refund policy.
7) Third-Party Services & Providers
Links to third-party sites and coordination with providers are offered for your convenience. PtP does not control or endorse third-party services and is not responsible for their practices, availability, or outcomes. Provider-patient relationships are solely between you and your providers.
8) Disclaimers
The Platform is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, PtP disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted, timely, secure, or error-free operation or the accuracy or reliability of content.
9) Limitation of Liability
To the maximum extent permitted by law, PtP and its affiliates, officers, directors, employees, and agents shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, or goodwill, arising out of or relating to your use of the Platform, even if advised of the possibility of such damages.
In all events, PtP’s total liability for any claim shall not exceed the greater of (a) amounts you paid to PtP for access to the Platform in the twelve (12) months before the event giving rise to the claim, or (b) one hundred US dollars (US $100).
10) Indemnification
You agree to defend, indemnify, and hold harmless PtP and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (i) your use of the Platform; (ii) your violation of these Terms or applicable law; or (iii) your content or information uploaded or provided through the Platform.
11) Arbitration & Class Action Waiver
Any dispute, claim, or controversy arising out of or relating to these Terms or the Platform shall be resolved by binding arbitration administered by JAMS (or AAA) under its applicable rules, on an individual basis. You and PtP waive any right to a jury trial or to participate in a class action or class arbitration. Notwithstanding the foregoing, either party may seek injunctive or equitable relief in a court of competent jurisdiction to protect intellectual property or confidential information.
12) Suspension & Termination
We may suspend or terminate access to the Platform at any time for any reason, including violation of these Terms or risk to security or operations. Upon termination, provisions that by their nature should survive (e.g., IP, disclaimers, liability limits, arbitration) shall survive.
13) General Terms
- Governing Law: California law, without regard to conflicts principles.
- Severability: If any term is unenforceable, the remainder remains in effect.
- No waiver: Failure to enforce a provision is not a waiver.
- Changes: We may update these Terms. Continued use after updates constitutes acceptance.
- Entire agreement: These Terms constitute the entire agreement between you and PtP regarding the Platform.
